A. RESERVATION & PAYMENT POLICY

1. BOOKING –

Booking can be made by way of phone (03-26935154 , sms: 016-2898260) or in writing either by way of facsimile (03-26945154) or email (mybatiktour@tmsart.com.my).

2. DEPOSIT REQUIREMENT -

In order to secure your booking, a non-refundable 35% deposit of the total package charges  must be paid within 7 days after the initial booking otherwise the booking will be cancelled .  The balance of the total package charges  must be fully settled 30 days before the departure date otherwise the deposit will be forfeited absolutely. If your booking is made within 30 days or less before the departure date, the total package charges is payable immediately upon confirmation.

3. PAYMENT -

Payment may be made either by telegraphic transfer or by credit card.

a)         PAYMENT BY CREDIT CARD -

Payment made at the credit card terminal at the following address will not be subjected to tax charges:-

B. TERMS AND CONDITIONS OF PURCHASE

All bookings are subject to the terms and conditions set out below:-

1. PRICES AND EXCHANGE RATES –

We reserve the right to alter the total package charges at any time prior to your booking due to continuing variation of air fares, unforeseen circumstances and exchange rate fluctuations.

2. EXCHANGE RATES –

The total package charges are quoted in local currency (RM Malaysian Ringgit). The exchange rate will be taken as the rate available at the time of invoicing. Exchange rates are determined by TMS Art Marketing Sdn. Bhd solely.

3. REMOVAL OF TRAVEL PRODUCTS -

We reserve the right at any time and from time to time to remove, modify or discontinue, temporarily or permanently out travel products (or any part thereof) with or without notice. You agree that TMS Art Marketing Sdn. Bhd. shall not be liable to you or to any third party in any way for any modification suspension or discontinuance of the travel products.

4. NON-AVAILABILITY –

All Travel Products offered are subject to availability and acceptance, at the discretion of our suppliers of such product or service. In the event a travel product booked by you is not available, we shall suggest you an alternative product or service of similar pricing and quality. If you fail to accept our suggested alternative travel product by the specified deadline, we reserve our right to cancel our tentative booking of the same.

5. FLIGHT BOOKING -

Flight tickets cannot be issued without full pre-payment. The airlines reserve the right to increase prices at any time, and we are not able to guarantee the price shown on the confirmation invoice. Please note that airfares are constantly changing and usually increasing. Very often there is little or no notice of these increases, but very rarely do increases apply to tickets already issued. It is therefore to your advantage to finalise payment as soon as you can

after booking, and so reduce any risk of surcharge.

6. EVENTS BEYOND OUR CONTROL –

These include: unusual, unforeseeable or unavoidable events beyond our control, the consequences of which could not be avoided even if all due care has been exercised including but not limited to war, threat of war, riot, civil disobedience or strife, government action,  terrorist activity, natural or industrial disaster, fire, adverse weather conditions, level of water in rivers or floods, closure of airports and may also include industrial dispute involving third parties, technical or maintenance problems or unforeseen operational decisions of air carriers such as changes of schedule. Except where otherwise expressly stated in these booking conditions we shall not be hold liable for any losses or damages where the performance of our contractual obligations is prevented or affected by reason of such events  beyond our control.

7. TRAVEL REQUIREMENTS –

It is your responsibility to obtain a visa (where required) and other relevant travel document at your own costs. You must be in possession of a valid passport required for entry, departure and travel through each destination point along the itinerary of the tour, (your passport must be valid for at least 6 months after your return date), and be in possession of all necessary visas, permits and certificates including vaccination certificates, insurance policies, required for the whole of the journey. Any information or advice given by TMS Art Marketing Sdn. Bhd. regarding visas, vaccinations, climate, clothing, baggage, special equipment, etc. is purely advisory, provided as a courtesy and that TMS Art Marketing Sdn. Bhd. is not responsible for any errors or omissions as to the information provided.

8. CLAIMS & COMPLAINS -

If you have a problem during your holiday it is of the utmost importance that you immediately bring it to the attention of the relevant person (for example the hotel manager, the tour guide) who will do their best to put things right. If your complaint is not resolved, you should contact our office to advise us of the problem so that we may endeavour to resolve it. However, should a problem remain unresolved, a complaint should be made in writing within 7  days after your return. We will not accept any liability for any claims received after this period.


9. PERSONAL BELONGINGS -

Luggage and personal belongings are solely your own responsibility. Do not leave your personal belongings unattended even for a minute, in the vehicles. TMS Art Marketing Sdn. Bhd. is not responsible for any loss, theft or damage to your baggage or personal belongings during the tour be it during your stay in the hotel or during the journey of travelling.

10. WEATHER CONDITIONS -

Under no circumstances shall TMS Art Marketing Sdn. Bhd be held responsible for weather conditions. TMS Art Marketing Sdn. Bhd accepts no responsibility for weather conditions that may affect the delivery and implementation of the itinerary.

11. ACCURACY –

Every effort is made to ensure the accuracy of vouchers and other travel documents at the time of issuing and TMS Art Marketing Sdn. Bhd shall not be held responsible for any typographical errors, or errors arising from any unforeseen circumstances. It is your responsibility to ensure that all of the details on your travel documents are correct and to bring to our attention any errors or discrepancies immediately.

12. PICK UP AND DROP OFF POINTS &TIME -

It is your responsibility to be at the starting point of tour on time. In the event you miss a planned departure, any extra travel costs incurred are to be paid by you and . TMS Art Marketing Sdn. Bhd will endeavour to ensure that departure and arrival times are met and shall not be held liable for any changes made last minute and should you miss the connecting service at any point of time, .

If the driver has not turned up within 30  minutes of the agreed time, and the driver has not contacted you to explain his delay, then please contact TMS Art Marketing Sdn. Bhd. immediately. Should you failed to do so, TMS Art Marketing Sdn. Bhd shall not be held liable for any losses and damages suffered by you.

13. AIRPORT PICK UP & FLIGHT DELAYS –

The driver will normally wait up to 60 minutes after your flight has landed before making enquiries with the airline, customs or immigration. After this procedure and if there is no sign of the passenger, the driver will leave the airport. If you are delayed more than 1 hour in customs, immigration, baggage collection or lost luggage please call TMS Art Marketing Sdn. Bhd. to ensure that the driver will wait.

Please note that if there is a last minute change in timing of the flight or a delay which has not previously been advised, TMS Art Marketing Sdn. Bhd. shall not refund the cost of the lost transfer service and you will be required to make your own arrangements at arrival.

14. CUSTOMS & IMMIGRATIONS DELAYS / ENQUIRIES -

TMS Art Marketing Sdn. Bhd shall not be held responsible if passengers are stopped or held by any government departments, e.g. Police, Customs, Immigrations or any other authorities of the destination country. The tour will continue and no financial or any other kind of responsibility will be accepted by TMS Art Marketing Sdn. Bhd.

15. PRIVACY POLICY -

In order to make your booking and ensure that your travel arrangements run smoothly, and in accordance with your requirements, we need to use the information that you provide and pass this onto suppliers. This information may include your name, address, age, passport number and any special needs, disabilities, dietary requirements etc.

16. PHOTOGRAPHY & TESTIMONIAL -

Any likeness or image of you secured or taken on during the tour  or any written feedback may be used by TMS Art Marketing Sdn. Bhd., for bona fide promotional or marketing purposes, including but  not limitated  to promotional materials of any kind such as brochures, slides, video shows or in the website .

17. TRAVEL INSURANCE -

We strongly recommend that you do not travel without adequate Travel Insurance for your own protection and peace of mind. It is your responsibility to ensure that you purchase adequate travel insurance for your needs.

18.CANCELLATION OF THE PACKAGE

Should you cancel your booking within 30 days before the departure and after full payment of the total package charges, TMS Marketing Sdn Bhd will not refund the payment made. However TMS Marketing Sdn Bhd will endeavour to make the necessary arrangement to change the air flight itinerary or the entire tour package for you at its sole discretion and subject to its availability any cancellation fees, amendment fees or other extra charges payable shall be borne by your absolutely and a new confirmation invoice will be issued.

19. LAW & JURISDICTION -

Any claim or dispute arising from or related to this contract will be governed by Malaysian law and the courts of Malaysia shall have exclusive jurisdiction over any claim arising out of it.
